Terms & Conditions
1.GENERAL
A. Unless otherwise agreed by NW Landscape Ltd in writing the below
Terms and Conditions shall apply to all goods and services made by NW Landscaspe Ltd to the exclusion of all other terms, conditions and warranties.
2.GUARANTEES
A. All work installed by NW Landscape Ltd is guaranteed. The installation guarantee is for 12 months from installation.
B. The buyer must retain their invoice as proof of purchase and guarantee.
C. Guarantee only covers against manufacturing & installation defects.
D. Recommended maintenance from the supplier of the materials must be adhered to.
E. In the event of a defect arising, which may be covered by this guarantee, full written details must be submitted to the company within seven days of the discovery of the alleged defect.
F. The person insured is the person named in the schedule and is none transferable.
Note: This guarantee is offered as an additional benefit by the company and in no way affects your statutory rights.
G: Force Majeure: A Force Majeure Event means any event beyond a party's reasonable control, which by its nature could not have been on foreseen, or, if it could have been foreseen, was unavoidable, including strikes, lock-outs or other industrial disputes (whether involving its own workforce or a third party's), failure of energy sources or transport network, acts of God, war, terrorism, riot, civil commotion, interference by civil or military authorities, national or international calamity, armed conflict, malicious damage, breakdown of plant or machinery, nuclear, chemical or biological contamination, sonic boom, explosions, collapse of building structures, fires, floods, storms, earthquakes, loss at sea, epidemics or similar events, natural disasters or extreme adverse weather conditions, or default of suppliers or subcontractors.
H. The company and its servents will do their upmost to keep any damage to a minimum but it can not guarentee to avoid damage to any products that are in the way of installation; we ask that all areas are covered or removed before work commences.

PAVING & GROUNDWORKS
1.Any defects in workmanship during the construction of the patio or similar domestic installation will be made good free of charge for a period of up to 1 year.
2.The company shall endeavour to make good any remedial works in a colour, pattern and finish as specified in the original contact; but no assurance can look be given that an exact recreation may be achieved as this depends upon the availability of materials and area size.
3. This guarantee covers the installation for reasonable domestic use, but does not extend to cover damage resulting from accident, misuse, neglect, lack of maintenance (including re-pointing if necessary) impact damage, commercial or industrial use, or staining caused by any substance whatsoever.
4. Settlement attributable to the construction of the works is covered but settlement attributable to construction of work not the responsibility of the company is not covered. Cover for any settlement in the ground at a level lower than that exposed during construction, resulting from, for example, the failure or collapse of any pre-existing installation, is excluded.
5. Movement, expansion or contraction or subsoil or base due to changes in temperature, water content and tree root activity are outside the control of the company and no guarantee can therefore be given should any damage occur due to these or related factors.
6.We do not cover manufacturing failures, this must be taken up with the manufacturer themselves following their T&C’s. please note: guarantees are for the structure and not the product, products would need to be taken up with the supplier. We will be happy to liaise with this.
7. In their early life products may appear to loose some intensity of colour or even experience a milky white stain on the surface. This may be attributable to a phenomenon known as efflorescence, which is of a temporary nature, and is not harmful to the performance of the paving. The installer cannot accept responsibility for the occurrence of this defect and the product will be covered under the terms of the supplier.
8. It is important for the paving to receive regular maintenance in accordance with the recommendations of the manufacturer of the product. The company will advise on the requirements, but if maintenance is neglected this will not become the liability of the company.

YOUR RIGHTS
You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you if we intend to use your data for such purposes or if we intend to discloseyour information to any third party.
DISPUTES

GOODS
A. Goods remain the property of NW Landscape Ltd until the contract value is paid in full.
B. If payment is overdue, the buyer gives NW Landscape ltd the right to enter onto its property, or any other property where the goods are reasonably thought to be, for the purpose of recovering the property of NW Landscape Ltd. The Buyer will be responsible for all costs incurred by NW Landscapde Ltd in recovering the goods.
